A RESOLUTION DESIGNATING AUTHORIZED GRANT AGENTS FOR THE FEDERAL EMERGENCY MANAGEMENT AGENCY AND THE GOVERNOR’S OFFICE

summary

Summary:

In response to the early February 2024 winter storms, the City declared a local emergency in accordance with California Government Code 8625 and the Signal Hill Municipal Code. Subsequently, staff submitted an application to the Governor’s Office of Emergency Services (CalOES) and Federal Emergency Management Agency FEMA requesting reimbursement for emergency expenses related to the storm.  As part of this process, CalOES Form 130 requires the City to designate staff authorized to engage with FEMA and CalOES regarding the assistance and grants applied for by the City. The City Council will consider adopting a Resolution to designate staff by title as authorized grant agents for FEMA and CalOES.

Background and Analysis:

On February 4, 2024, Governor Gavin Newsom proclaimed a State of Emergency for eight counties in Southern California, including Los Angeles County, as a series of winter storms began impacting much of the State with high winds, damaging rain, and heavy snowfall. By February 6, 2024, the City experienced rainstorm damage at Panorama Promenade Trail along with Molino Avenue and 20th Street, resulting in conditions that impacted the safety of persons and property, and were beyond the City’s control, exceeding the capacity of its services, personnel, equipment, and facilities, and requiring extraordinary measures. As a result, on February 7, 2024, the City Manager, in his role as the Director of Emergency Services, signed a proclamation of a local emergency in response to the February 2024 winter storm activity.

On April 13, 2024, President Biden issued a Major Disaster Declaration for the State of California to supplement recovery efforts in the areas affected by the severe winter storms, tornadoes, flooding, landslides, and mudslides from January 31 to February 9, 2024. This declaration made Public Assistance for federal funding available on a cost-sharing basis for emergency work and the repair or replacement of facilities damaged by the storms.

As required by the Federal and State reimbursement process, the City applied for both Public Assistance funding through FEMA and California Disaster Assistance Act (CDAA) funding through CalOES. CalOES requires a Designation of Subrecipient's Agent Resolution (CalOES Form 130) for Non-State Agencies to be on file to be eligible to receive funding (Attachment A).  This designation is a requirement under Public Law 93-288, as amended by the Robert T. Stafford Disaster Relief and Emergency Assistance Act of 1988, and/or state financial assistance under the California Disaster Assistance Act. A new Designation of Applicant's Agent Resolution for Non-State Agencies is required if the previously submitted document is older than three (3) years from the last date of approval or if changes are needed to the name and/or title of authorized agents. In addition to the Cal OES Form 130, the attached Resolution designates the City Manager, Finance Director, Deputy Finance Director, and Emergency Management Coordinator as the authorized agents for the City (Attachment B).
