Summary:
With the passage of Assembly Bill 179 into law, the State approved funding for the City of Signal Hill in the amount of $5,000,000 to construct a new outdoor amphitheater at Signal Hill Park. The California Arts Council (CAC) is the designated State entity responsible for allocation of the grant funds to the City and ensuring grant funds are used for the purposes specified. Prior to payment of grant funds, CAC requires submission of a grant application that includes information about the project and execution of a grant agreement. Adoption of this resolution provides City Council’s approval of the grant application and authorizes the City Manager to execute all necessary documents to receive and expend the awarded grant funds.

Fiscal Impact:
The grant amount of $5,000,000 will fund the design and construction of the Signal Hill Park Amphitheater Project. The initial receipt of funds will be recorded in the Capital Grants Fund (240).

Background and Analysis:
On September 6, 2022, Governor Gavin Newsom signed Assembly Bill 179 which approved $5,000,000 to be allocated by the CAC to the City for the Signal Hill Park outdoor amphitheater. Staff worked with Senator Lena A. Gonzalez’s office for procurement of the grant and submission of applicable documents. According to Section 19.56 of the Budget Act of 2022, funds shall be available for encumbrance through June 30, 2024, and expenditure until June 30, 2026. The designated State entity (CAC) shall allocate funds to the recipient (Signal Hill) and shall determine the best method for allocation to ensure funds are used for the purposes specified. Consistent with this provision, the CAC requested on February 28, 2023, that the City submit a grant application by March 31, 2023, to include information about the project and a resolution from City Council approving the application for grant funds. Upon disbursement of the grant funds, the State may continue to perform audits, as frequently as annually, and for three years following payment of the grant funds.
After execution of the grant agreement with CAC, and upon receipt of payment of the grant amount, staff will proceed with the initial planning of the amphitheater and integration with an overall Signal Hill Park plan, community outreach, environmental review, and engineering design phases of the project. Staff will coordinate the City’s project with the CAC to ensure the project remains eligible for funding throughout the design and construction process.
