Summary:

 

On May 26, 2026, the City Council adopted resolutions initiating proceedings for the annual levy and collection of assessments for Landscape and Lighting Maintenance District No. 1 (LLMD) and scheduled a public hearing for June 9, 2026, to consider the proposed Fiscal Year (FY) 2026-27 assessments.

 

Following preparation of the public hearing notice, staff determined that additional time is necessary to satisfy the publication requirements prescribed by the Landscaping and Lighting Act of 1972. To ensure full compliance with all noticing requirements, staff recommends rescheduling the public hearing from June 9, 2026, to June 23, 2026.

 

The proposed action does not modify the Engineer’s Report, proposed assessment amounts, assessment methodology, or any other substantive component of the annual assessment proceedings. The proposed resolution solely amends the public hearing date to allow sufficient time to complete the required public noticing process. Staff recommends that the City Council adopt a resolution amending Resolution No. 2026-05-6934 and rescheduling the public hearing for June 23, 2026.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SIGNAL HILL, CALIFORNIA, AMENDING RESOLUTION NO. 2026-05-6934 DECLARING ITS INTENTION TO LEVY AND COLLECT ASSESSMENTS FOR LANDSCAPE AND LIGHTING MAINTENANCE DISTRICT NO. 1 FOR FISCAL YEAR 2026-27 TO REVISE THE PUBLIC HEARING DATE.

Fiscal Impact:

 

There is no fiscal impact associated with the recommended action. The proposed action solely revises the public hearing date to comply with statutory noticing requirements. The proposed assessments, projected revenues, expenditures, and reserve balances for Landscape and Lighting Maintenance District No. 1 remain unchanged.

 

Background and Analysis:

 

The City formed Landscape and Lighting Maintenance District No. 1 in 1992 to fund maintenance activities within the California Crown Tract. Annually, the City Council conducts proceedings pursuant to the Landscaping and Lighting Act of 1972 to levy and collect assessments necessary to fund district operations and maintenance activities.

 

On May 26, 2026, the City Council adopted resolutions initiating assessment proceedings for FY 2026-27, approving the Engineer's Report, and scheduling a public hearing for June 9, 2026, to consider the proposed annual assessments.

 

The Landscaping and Lighting Act of 1972 requires publication of a notice of public hearing within specified timeframes prior to the hearing date. Staff has determined that additional time is necessary to satisfy the required publication schedule. To ensure compliance with all statutory noticing requirements and maintain the validity of the assessment proceedings, staff recommends amending Resolution No. 2026-05-6934 to revise the public hearing date from June 9, 2026, to June 23, 2026.

 

The proposed action does not alter the FY 2026-27 Engineer's Report, proposed assessments, assessment methodology, district boundaries, or any previously approved actions of the City Council. The amendment solely revises the public hearing date and authorizes staff to publish the required public notice in accordance with the Landscaping and Lighting Act of 1972 (Attachment A).

 

If approved, staff will publish the public hearing notice and return to the City Council on June 23, 2026, for consideration of the annual levy and collection of assessments for FY 2026-27.
